Lecture 3 presents four sample diagnostic essays on fashion piracy (two written by humans, two by ChatGPT) to illustrate what strong and weak academic writing looks like. The comparison highlights the value of synthesis over summary, the importance of concrete data, and the characteristic shortcomings of AI-generated academic writing.
Diagnostic (in this course)
A preliminary essay assignment in which students synthesise several assigned sources on a topic (here, fashion piracy and intellectual property in fashion).
Synthesis (as essay structure)
An essay organised by idea, drawing on multiple sources within each section. Contrast with a summary-style structure that works through sources one at a time.
Expository writing
Writing that presents facts and information so the reader can draw their own conclusions. No persuasion or call to action.
Argumentative writing
Writing that takes a position and attempts to persuade the reader.
Copyright
Legal protection granting creators exclusive rights over their original works. Applies to music, literature, film, and fine art, but notably does not apply to fashion designs in the United States.
Trademark
A form of intellectual property protection covering brand names, logos, and symbols (e.g. the Nike swoosh, the North Face name). In fashion, this is the only IP protection available to designers.
Fast fashion
A business model built on rapidly copying runway and high-end trends and producing them cheaply at high volume. Companies like Shein, Zara, H&M, and Forever 21 exemplify this model.
U.S. courts classify clothing as a utilitarian product, in the same category as a ladder or a toothbrush
Courts do not want individual designers holding copyright over basic design elements like collars, sleeves, or belt loops
The result: a designer can copy every aspect of a garment except the brand name or logo (Blakley, 2010; "Why this Gucci", 2018)
Designers' only recourse is trademark protection, which covers logos and brand names but not the look or shape of a design
Copying creates trends. Example: Batsheva Hay's puffy-sleeve dresses (c. 2018), inspired by Hasidic and Amish garments, were soon copied by J. Crew, Shein, and others (Mull, 2022)
Trends drive sales because fashion-conscious consumers eventually tire of a look and buy into the next one
This cycle is a major reason the U.S. fashion industry generates hundreds of billions in annual revenue, more than any other creative industry (Sprigman & Raustiala, 2016; Blakley, 2010)
Many consumers are indifferent to copying. Siovhan McGearey (teenage shopper): "Why pay $300 when you can go down the street to Forever 21 and get jeans that are $30 that look exactly the same?" (Wilson, 2007, p. 3)
Copies give consumers access to high-end looks at lower price points. Gucci's Princeton Leather Slipper retails for $995; copies start at $35 ("Why this Gucci", 2018)
But cheap copies fuel overconsumption: American women now own four times as many clothes as in the 1980s (Zentouro, 2015)
The average American disposes of 84 pounds of textiles per year (Zentouro, 2015)
It takes 2,700 litres of water to grow the cotton for a single t-shirt (Zentouro, 2015)
20,000 litres of water for enough cotton for a pair of jeans and a t-shirt combined (Zentouro, 2015)
Trends help sell clothes, but not all designers benefit equally
Fast fashion giants (Shein, Zara, H&M, Forever 21) capture most of the profit
Young or independent designers who originate trends often fail to capitalise. Narciso Rodriguez created a dress style that sold millions of copies, but only 45 sales were his own (Paul, n.d.)
Forever 21 has been accused of extensive copying and does not employ a single designer (Lo, 2011)
Scafidi and Rodriguez (2015) proposed legislation offering designers copyright protection for novel designs for three years, citing successful protections already in place for jewellery and textile design
Sprigman and Raustiala (2016) countered that piracy benefits designers by creating trends that drive sales
Jimenez (2014) argued the U.S. should follow the EU model, where fast fashion companies like H&M and Zara must hire their own designers and add original elements rather than doing line-for-line copying

Weaker as a synthesis because ideas are not grouped thematically
Summarises each source in a separate paragraph
Language is notably vague: "explores the complex landscape," "sheds light on the tensions," "paints a multifaceted picture"
Almost no specific data, no quotations, no concrete examples
Does not explain any abstract ideas step by step
A reader who had not already read the sources would learn very little from this diagnostic
Reads like a generic opinion essay rather than a source-based diagnostic
Presents claims without grounding them in the assigned sources
No quotations, no specific data from sources, no paraphrasing of particular arguments
Repeats the same supporting idea (that knockoffs undermine designers' investment) in multiple sections
Tone is grandiose and imprecise: "harmonious equilibrium," "the ever-evolving landscape of the fashion industry"
⚠️ The difference between Version A (synthesis) and Version B (summary) is one of the central evaluation criteria for the diagnostic. Organise by idea, not by source.
⚠️ The AI-written versions (C and D) show what to avoid: vagueness, lack of specific data, no real engagement with source material, and repeated ideas.
⚠️ The Diagnostic is expository, not argumentative. The goal is to inform, not to persuade.
⚠️ Balancing quantitative and qualitative data is a skill the course explicitly tests. Count up each type in your own writing to check your balance.
⚠️ If you reference an abstract concept (e.g. why fashion lacks copyright), explain it step by step so an unfamiliar reader can follow.
